  1. MICROSOFT INTERNET EXPLORER, VERSION 4.0, AND SOFTWARE RELATED COMPONENTS.

  3. END-USER LICENSE AGREEMENT FOR MICROSOFT SOFTWARE
  4.  
  5. IMPORTANT-READ CAREFULLY:  This Microsoft End-User License Agreement 
  6. ("EULA") is a legal agreement between you (either an individual or a 
  7. single entity) and Microsoft Corporation for the Microsoft software 
  8. product(s) identified above which may include associated software 
  9. components, media, printed materials, and "online" or electronic 
  10. documentation ("SOFTWARE PRODUCT"). By installing, copying, or 
  11. otherwise using the SOFTWARE PRODUCT, you agree to be bound by the 
  12. terms of this EULA. If you do not agree to the terms of this EULA, 
  13. do not install or use the SOFTWARE PRODUCT.  If the SOFTWARE PRODUCT was
  14. purchased by you, you may return it to your place of purchase for a 
  15. full refund.
  16.  
  17. The SOFTWARE PRODUCT is protected by copyright laws and international 
  18. copyright treaties, as well as other intellectual property laws and 
  19. treaties. The SOFTWARE PRODUCT is licensed, not sold.
  20.  
  21. 1.    GRANT OF LICENSE.  The SOFTWARE PRODUCT is licensed as follows:
  22.  
  23. * Installation and Use. Microsoft grants you the right to install and 
  24. use copies of the SOFTWARE PRODUCT on your computers running validly
  25. licensed copies of the operating system for which the SOFTWARE PRODUCT 
  26. was designed [e.g., Windows(r) 95; Windows NT(r), Windows 3.x, 
  27. Macintosh, etc.].  
  28.  
  29. * Backup Copies.  You may also make copies of the SOFTWARE PRODUCT as 
  30. may be necessary for backup and archival purposes.  
  31.  
  32. * Components.  Certain software components of the SOFTWARE PRODUCT 
  33. are subject to the following additional provisions: 
  34.  
  35. DCOM95.  You may only use copies of the DCOM95 component on computer(s)
  36. for which you have licensed Microsoft Windows operating system platforms.
  37.  
  38. NetMeeting.  NetMeeting contains technology that enables applications 
  39. to be shared between two or more computers, even if an application is 
  40. installed on only one of the computers.  You may use this technology 
  41. with all Microsoft application products for multi-party conferences. 
  42. For non-Microsoft applications, you should consult the accompanying 
  43. license agreement or contact the licensor to determine whether 
  44. application sharing is permitted by the licensor.
  45.  
  46. Internet Assistants and Internet Viewers:  You may reproduce and 
  47. distribute an unlimited number of copies of these components of the 
  48. SOFTWARE PRODUCT; provided each copy shall be a true and complete copy, 
  49. including all copyright and trademark notices, and shall be accompanied
  50. by a copy of this EULA.  Copies of these components may be distributed
  51. as a standalone product or included with your own product.
  52.  
  53. Microsoft Agent. You may distribute Microsoft Agent and its associated
  54. charaters and speech engines in accordance with terms of a separate 
  55. end user license agreement.  See the "EULA.htm"
  56. file located at http://www.microsoft.com/workshop/prog/agent/ for 
  57. further details.

  59. 2.    DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
  60. * Maintenance of Copyright Notices.  You must not remove or alter any 
  61. copyright notices on all copies of the SOFTWARE PRODUCT.
  62. * Distribution.  You may not distribute copies of the SOFTWARE PRODUCT
  63. to third parties.
  64. * Prohibition on Reverse Engineering, Decompilation, and Disassembly.  
  65. You may not reverse engineer, decompile, or disassemble the SOFTWARE 
  66. PRODUCT, except and only to the extent that such activity is expressly 
  67. permitted by applicable law notwithstanding this limitation.
  68. * Rental.  You may not rent, lease, or lend the SOFTWARE PRODUCT.
  69. * Transfer.  You may permanently transfer all of your rights under 
  70. this EULA, provided the recipient agrees to the terms of this EULA.
  71. * Support Services.  Microsoft may provide you with support services 
  72. related to the SOFTWARE PRODUCT ("Support Services").  Use of Support 
  73. Services is governed by the Microsoft polices and programs described 
  74. in the user manual, in "on line" documentation and/or other 
  75. Microsoft-provided materials. Any supplemental software code provided 
  76. to you as part of the Support Services shall be considered part of the 
  77. SOFTWARE PRODUCT and subject to the terms and conditions of this EULA.  
  78. With respect to technical information you provide to Microsoft as part 
  79. of the Support Services, Microsoft may use such information for its 
  80. business purposes, including for product support and development.  
  81. Microsoft will not utilize such technical information in a form that 
  82. personally identifies you.
  83. * Compliance with Applicable Laws.  You must comply with all applicable
  84. laws regarding use of the SOFTWARE PRODUCT.
  85.  
  86. 3.    TERMINATION.  Without prejudice to any other rights, Microsoft
  87. may terminate this EULA if you fail to comply with the terms and 
  88. conditions of this EULA. In such event, you must destroy all copies 
  89. of the SOFTWARE PRODUCT.
  90.  
  91. 4.    COPYRIGHT.  All title, including but not limited to copyrights, 
  92. in and to the SOFTWARE PRODUCT and any copies thereof are owned by 
  93. Microsoft or its suppliers. All title and intellectual property rights 
  94. in and to the content which may be accessed through use of the SOFTWARE
  95. PRODUCT is the property of the respective content owner and may be 
  96. protected by applicable copyright or other intellectual property laws 
  97. and treaties.  This EULA grants you no rights to use such content.  
  98. All rights not expressly granted are reserved by Microsoft.
  99.  
  100. 5.    U.S. GOVERNMENT RESTRICTED RIGHTS.  The SOFTWARE PRODUCT is 
  101. provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by 
  102. the Government is subject to restrictions as set forth in subparagraph 
  103. (c)(1)(ii) of the Rights in Technical Data and Computer Software clause 
  104. at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) of the Commercial 
  105. Computer Software Restricted Rights at 48 CFR 52.227-19, as applicable.

  107. 98052-6399.

  109. 6.    EXPORT RESTRICTIONS.  You agree that you will not export or 
  110. re-export the SOFTWARE PRODUCT to any country, person, entity or end 
  111. user subject to U.S.A. export restrictions.  Restricted countries 
  112. currently include, but are not necessarily limited to Cuba, Iran, 
  113. Iraq, Libya, North Korea, Sudan, and Syria.  You warrant and represent 
  114. that neither the U.S.A. Bureau of Export Administration nor any other 
  115. federal agency has suspended, revoked or denied your export privileges.

  117. 7.    NOTE ON JAVA SUPPORT.  The SOFTWARE PRODUCT may contain support 
  118. for programs written in Java.  Java technology is not fault tolerant and
  119.  is not designed, manufactured, or intended for use or resale as on-line
  120.  control equipment in hazardous environments requiring fail-safe 
  121. performance, such as in the operation of nuclear facilities, aircraft
  122.  navigation or communication systems, air traffic control, direct life 
  123. support machines, or weapons systems, in which the failure of Java 
  124. technology could lead directly to death, personal injury, or severe 
  125. physical or environmental damage.
  126.  
  127. 8.    NO WARRANTIES.  Microsoft expressly disclaims any warranty for 
  128. the SOFTWARE PRODUCT.  THE SOFTWARE PRODUCT AND ANY RELATED 
  129. DOCUMENTATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, 
  130. EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED 
  131. WARRANTIES OR MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR 
  132. NONINFRINGEMENT.  THE ENTIRE RISK ARISING OUT OF USE OR PERFORMANCE OF
  133. THE SOFTWARE PRODUCT REMAINS WITH YOU.

  135. 9.    LIMITATION OF LIABILITY.  To the maximum extent permitted by 
  136. applicable law, in no event shall Microsoft or its suppliers be liable 
  137. for any special, incidental, indirect, or consequential damages 
  138. whatsoever (including, without limitation, damages for loss of business 
  139. profits, business interruption, loss of business information, or any 
  140. other pecuniary loss) arising out of the use of or inability to use the 
  141. SOFTWARE PRODUCT or the provision of or failure to provide Support 
  142. Services, even if Microsoft has been advised of the possibility of such 
  143. damages. In any case, Microsoft's entire liability under any provision 
  144. of this EULA shall be limited to the greater of the amount actually 
  145. paid by you for the SOFTWARE PRODUCT or US$5.00; provided however, if 
  146. you have entered into a Microsoft Support Services Agreement, 
  147. Microsoft's entire liability regarding Support Services shall be 
  148. governed by the terms of that agreement. Because some states and 
  149. jurisdictions do not allow the exclusion or limitation of liability, 
  150. the above limitation may not apply to you.

  152. 10.    MISCELLANEOUS.
  153.  
  154. This EULA is governed by the laws of the State of Washington, U.S.A.
  155.

  188. La prΘsente Convention est rΘgie par les lois de la province d'Ontario, 
  189. Canada. Chacune des parties α la prΘsente reconnaεt irrΘvocablement 
  190. la compΘtence des tribunaux de la province d'Ontario et consent 
  191. α instituer tout litige qui pourrait dΘcouler de la prΘsente auprΦs 
  192. des tribunaux situΘs dans le district judiciaire de York, province 
  193. d'Ontario.
